Earlier this May, the Los Angeles County Sheriff voiced concerns about “ghost gun” kits that enable anyone, including felons and other individuals prohibited from possessing firearms, to access a gun. Ghost guns, which are available online and at most gun shows, allow you to purchase a partially assembled firearm and finish building it on your own. While California and a few other states, including New Jersey, Connecticut, and Washington, have taken steps to restrict access to ghost gun kits, Los Angeles law enforcement officials are calling for national legislation addressing ghost gun kits.

Ghost Guns vs. Traditional Firearms

Under federal law, guns must have serial numbers, and a purchaser must go through a background check before obtaining a firearm. Selling or possessing a firearm without a serial number is unlawful, and you could face criminal consequences for violating these requirements. In contrast, ghost guns arrive only partially assembled, and their various components do not need to have serial numbers because these items are merely independent pieces—not a complete gun. Additionally, background checks are not required for purchasers, as they are not technically buying a firearm.

Ghost Gun-Related Crimes on the Rise in Los Angeles

In Los Angeles County, investigations involving ghost guns have risen by 50 percent within the last year. The Saugus High School shooting in November of 2020 involved a ghost gun, prompting Los Angeles County Sheriff Alex Villanueva to call for action at the federal level. Even if states enact their own ghost gun legislation, inconsistencies between state laws could make it easier for potential offenders to evade prosecution. This focus on gun violence comes at a time when Los Angeles has experienced a nearly 67 percent increase in shootings over the past year.

Understanding Your Firearm Possession Rights in Los Angeles County

In the wake of increasing gun violence and calls for tighter ghost gun restrictions, it’s important to understand your rights. If law enforcement arrests you for unlawful possession of a firearm or a similar gun-related crime, exercise your right to remain silent and contact a trusted criminal defense lawyer as soon as possible to discuss your situation.
