How Gang Enhancements Can Impact Your Criminal Case in Los Angeles

Defining “Criminal Street Gang”

California state law defines the term “criminal street gang” as “any ongoing organization, association, or group of three or more persons, whether formal or informal, having as one of its primary activities the commission of one or more criminal acts.” A criminal street gang must also have a common name or symbol, and the members are known to engage in a pattern of criminal activity, whether alone or together. Unfortunately, these criteria are somewhat broad, so people who live in areas of frequent gang activity may face gang enhancements simply because of where they live and who their friends and acquaintances are. 

Significant Penalties

Felony convictions already carry weighty penalties, such as imprisonment and fines. It’s important to recognize that prosecutors do not have to show that you are an active member of a criminal street gang in order for you to be subject to gang enhancements. They must simply demonstrate that the felony was committed at the direction of, in association with, or to benefit the gang in some way. Depending on the specifics of the case, a gang enhancement for any felony can range from an additional two to four years of imprisonment. Gang enhancements for specific felonies, however, carry more severe penalties. For instance, a gang enhancement for a home invasion robbery carries an additional 15-year prison sentence.
