How California Law Defines Robbery

According to Penal Code Section 211, “Robbery is the felonious taking of personal property in the possession of another, from his person or immediate presence, and against his will, accomplished by means of force or fear.” A person may face first-degree robbery charges if the incident occurs in an inhabited residence, if the alleged victim has used or is near an ATM, or if the victim is a driver or passenger on a bus, taxi, or similar form of transportation. All other types of robbery are considered second-degree.

Penalties for Robbery Convictions in Southern California

First-degree robbery carries the potential for spending three, four, or six years in California state prison. However, if prosecutors show that you committed first-degree robbery in conjunction with two or more individuals, the prison sentence increases to three, six, or nine years. Depending on the specifics of your case, you may also face a fine of up to $10,000. Robbery in the second degree carries a prison sentence of two, three, or five years, up to $10,000 in fines, with a possibility for felony probation. One defendant could face multiple counts of robbery if the criminal act involved more than one victim.
